Why Everyone Needs An Estate Plan

Put simply, when you make an estate plan, you make important decisions in advance about your health and your property, and you give those decisions legal authority. Even if you don't have a lot of assets to pass on, this will spare your loved ones from a lot of confusion and frustration, and save them a lot of time and money. When a person passes away, the law refers to that person's property as the estate. A probate court oversees the process of settling the estate, which can include paying outstanding debts and taxes, and distributing the remainder to family members.

If the person left no estate plan, the probate court uses guidelines under state law to distribute the assets of the estate. Essentially, the court must research the person's family tree and give the assets to relatives. The result can be very different from what the person would have wanted. The process takes time, and the costs come out of the estate. This means less money goes to the person's loved ones. In some cases, it can mean relatively distant relatives inherit everything while close companions are shut out.
